Terms of Service

1. Eligibility

You must be at least 18 years old, able to form a binding contract, and not barred from receiving services under applicable law.

2. The marketplace

DetailChimps is a marketplace. Detailing services are performed by independent professional providers ("Pros"), not by DetailChimps. We are not a party to the service contract between you and the Pro. We do not employ Pros, do not control how they perform a job, and make no representation or warranty regarding any specific Pro's work beyond our published vetting standards.

3. Accounts

• You are responsible for the activity under your account and for keeping your password confidential.
• You agree to provide accurate information and to update it when it changes.
• We may suspend or terminate accounts that violate these Terms or that we reasonably believe present fraud, safety, or legal risk.

4. Bookings and payments

• Prices, fees, taxes, and tips are shown before you confirm a booking. We may charge a non-refundable booking deposit.
• Payments are processed by Stripe. By providing a card you authorize us, via Stripe, to charge the amount shown and any subsequent amounts you authorize (tips, change orders, damage waivers).
• Pros are paid through Stripe Connect on the cadence we publish. Platform fees, processing fees, and applicable taxes are disclosed before payout.
• If a payment fails we may pause your account until the balance is settled.

5. Cancellations, no-shows, and rescheduling

• You may cancel free of charge until the cancellation cutoff shown at booking. After the cutoff a cancellation fee may apply.
• If a Pro is more than 30 minutes late without notice, you may cancel without a fee.
• No-shows on the customer side may be charged the full service price.

6. Quality and disputes

• If a job is not completed satisfactorily, open a dispute in the app within 72 hours. We may issue partial or full refunds at our discretion.
• Pros are required to carry their own insurance. DetailChimps is not responsible for damage to your vehicle or property caused by a Pro; claims must be made against the Pro and their insurer.

7. Pro terms

• Pros must complete background verification, maintain valid insurance, and follow our quality and conduct standards.
• Pros set their own working hours and accept jobs at their discretion.
• Pros may not contact customers outside the Platform for jobs sourced through DetailChimps.

8. Acceptable use

You will not: reverse engineer or attempt to extract source code; circumvent rate limits or security; scrape, harvest, or resell data; interfere with the Platform; submit unlawful, abusive, fraudulent, or infringing content; or use the Platform to harass, discriminate, or harm any person.

9. Intellectual property

The Platform, including our trademarks, software, and content, is owned by DetailChimps and its licensors. You retain rights to content you submit (photos, reviews) and grant us a non-exclusive, royalty-free, worldwide license to use it to operate and promote the service.

10. Disclaimers

The Platform is provided "AS IS" without warranties of any kind, express or implied. To the maximum extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits any non-waivable consumer rights you have under applicable law, including under the Consumer Protection Act (Quebec) and equivalent provincial laws.

11. Limitation of liability

To the maximum extent permitted by law, DetailChimps's aggregate liability arising out of or related to the Platform will not exceed the greater of CAD $100 or the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

12. Indemnification

You agree to defend, indemnify, and hold harmless DetailChimps from any claim arising out of your breach of these Terms, your content, or your misuse of the Platform.

13. Governing law and dispute resolution

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-laws principles. Disputes will be resolved by the courts of Toronto, Ontario, except where applicable consumer-protection law (including Quebec) requires otherwise. Quebec residents may bring claims in Quebec courts and consumer arbitration clauses do not apply where prohibited by law.

14. Changes to these Terms

We may update these Terms. We will give notice in-app or by email for material changes. Continued use of the Platform after the effective date means you accept the updated Terms.
